How To Rebound From Fortune Hi-Tech Marketing (FHTM) Lawsuit

If you recall, it wasn’t too long ago that Fortune Hi-Tech Marketing (FHTM) was issued a cease and desist order as well as its principals, Paul Oberson, Jeff Oberson, and Thomas Mills for violations of North Dakota transient merchant consumer fraud and home solicitation sales laws. This occurred December 10, 2009.

The problem was that FHTM failed to get a license that is required by the state.  This doesn’t sound like a big problem but this one violation opened the door to more scrutiny.  There seemingly were more accusations as to the possibility of whether the company was violating the pyramid law in North Dakota.  North Dakota prohibits promotional pyramid schemes in which the participant pays for the opportunity to receive income primarily from the recruitment of other participants rather than the sales of products and services.

But, this matter appeared to be a minor thing and quickly cleared up or it appeared to have cleared up.

On the Kentucky.com web site, there was a report on March 16th, 2010 that the state of Montana, after a five month investigation found Fortune Hi-Tech Marketing to be an illegal pyramid scheme.

Due to its violation, FHTM has been banned from the state of Montana.  The company is prohibited from doing business there.

Fortune Hi-Tech has many thousands of representatives in the U.S, Canada, and Great Britain.  In order to become a representative with Fortune, one has to pay $299.00, then sells products and services in health & beauty, services; such as GE Home Security, AT&T, Sprint, and Nextel, entertainment; such as, dish network, etc, and communications like their wireless shop, voice connect, and more.

The person at the top of the pyramid receives commissions from each sale and each new membership, which is considered to be legal because they sell products.  This is Fortune’s side of the story.  On the other hand, Montana disagrees.

Montana feels that FTHM is not a multi-level distribution company, but rather a pyramid company because the compensation each participant in the program receives is derived primarily from obtaining the participation of other persons in the program and not the sale of goods and services.  Hence, the cease and desist order.

Oh, by the way, back to my friend.  Like I said, my friend and business partner was panicking because he did not know what to do next until he got wind of this company.  So, he joined Numis Network and started calling everyone in his downline at his previous company.  He was able to get 80 of his members from his prior company to join by purchasing the executive package and in one day he made over $6K.  In four days, he now makes more than he did the whole six months while a member of his previous company.  And to think, he laughed at this company before joining because he felt that it was growing too fast; faster than the previous company.

Well, when he encountered the situation I just explained, all egos aside, he made the switch and is thankful he did.

    Fairly well written article telling the truth about FHTM. I only wish you would have saved the NUMIS marketing for a different piece.

    Fortune Hi-Tech has problems that expand beyond Montana. Investigations are under way in Kentucky, California, North Carolina, Texas, Illinois, New York and Florida.

    2010 will be their year to shine – but not the way Paul Orberson had expected..

    I am an Executive Manager with FHTM for over five years. You are misinforming the general public on how FHTM pays out bonus commissions.

    Other than training commissions, all bonus commissions such as Quick Start, Quick Start Bonus Over-rides and Leadership coded bonuses are paid ONLY when newly sponsored Managers acquires at least three personally gathered qualified customer points (i.e. Wireless, True Essentials nutrition, DishNetwork etc.) within their first sixty days.

    The resulting customer acquisition by all FHTM Independent Representatives (IR) are residual income from those customers monthly generated usages based on FHTM’s pay-plan.

    FHTMs Policies and Procedures (P&P) specifically outlines the Independent Representatives compensation plans and how bonus commissions are paid out. It also defines the operational requirements of all IR’s regarding compliance to all local, state and federal laws applicable to operating an FHTM IR business.

    That FHTM IR’s can not induce or entice prospective FHTM applicants using exaggerated income promises or deviating from the approved FHTM business opportunity presentation.

    Here lays the typical problem of a rapidly growing MLM Network Marketing company such as FHTM. In the process of record breaking growth, there have been IR’s that have been MIS-REPRESENTING the company’s marketing and compensation plans due to ignorance of the P&P or zealousness of the income opportunity.

    These actions have lead to complaints from those misinformed IR’s who joined FHTM (failed – quit) motivated by their perception on the ease of potential income based on misleading information delivered by local IR’s. This is not the fault of FHTM as our company P&P has strict requirements on how we must conduct our presentations and trainings. These problems are typically caused by misguided IR’s in the field.

    Because of our rapid growth and the scrutiny that any growing company will experience, FHTM has taken aggressive actions to enforce the companies P&P. IR’s who are found to have violated the P&P will be penalized, disciplined even terminated.

    I’m not here to discourage those who read your post to leave FHTM and jump ship with you. I’m here to tell the FACTS and set your depictions of FHTM’s temporary growing challenges straight.

    FHTM is a TERRIFIC well established, young yet rapidly growing company. The marketing concept is diversified due to its mix of multi-industries products and service offerings. The pay-plan is very generous compared to other top MLM company’s today. These are just some of the reasons why we are growing so fast.

    There will always be people out there who prey on the general publics ignorance, fears or greed. Your advice or invitation for FHTM IR’s who fear the minor challenges that FHTM is currently experiencing to join you on a new venture is simply just an example of those who are fishing for the weak and uncommitted people in FHTM.

    I have confidence and faith that FHTM will continue to prosper and expand. That these issues will soon be laid to rest as FHTM is now in the process of pro-actively affiliating and establishing business relationships with current and retired States Attorney Generals.

    This initiative is to help educate each states legal jurisdictions on FHTM’s business model and help circumvent any future misunderstandings regarding our company’s marketing and business format.

    To close… I encourage all FHTM IR’s to take a calm perspective on what is currently developing in FHTM. Understand that these are simply GROWING PAINS. It will all pass. DO NOT LET THE FEAR MONGERS SCARE YOU AWAY TO THEIR NEW OASIS. As you will find that their garden is not as lush as they claim. Instead, focus and commit yourself to becomming a well trained, educated, respectable and ETHICAL FHTM Professional.

    I want to thank you for your valuable comment. I do not wish to put down FHTM. This was not my purpose in writing the article on the company. I was told by one of the members of your company that it was actually the network marketing part of your company that was being shutdown. This meant that one could no longer establish an income from his or her downline.

    My purpose in writing the article was to share what I was told by a former member of your company. He was one of the leaders in your company and he was the one who said that FHTM was no more. He did not go into details but he was generating a five or six-figure income from FHTM. He worked hard on getting to this point. He said that he received a phone call from someone in the FHTM office and was told that he would no longer be receiving checks from the downline he had built. At that time, he was generating most of his income from his downline. If FHTM eliminates building a downline and much of your income is from that downline, what choice does one have but to look for another opportunity, which he did and has since joined that company.

    I apologize for any inconvenience I may have caused. Again, my only purpose was to share, with others, what I had been told by a former member of FHTM.
